1. Acceptance of Terms
By visiting, browsing or purchasing from efrainwhitt you agree to be bound by these Terms & Conditions. If you do not accept any part of this agreement you must discontinue use of the site immediately.
2. Eligibility
The service is available only to individuals who can form legally binding contracts under applicable law. You must be at least 18 years old and not barred from receiving our products under the laws of the United States, the European Union or your local jurisdiction.
3. Account Obligations
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify cs@efrainwhitt.shop at once if you suspect unauthorised access. We reserve the right to refuse service, terminate accounts or cancel orders at our sole discretion.
4. Product Information
We display colours, dimensions and textures as accurately as possible; however your monitor settings may alter perception. Slight variations in handmade or small-batch items are natural and not considered defects. Specifications may change without notice.
5. Orders & Acceptance
An order confirmation email does not signify our acceptance of your offer; it simply acknowledges receipt. We reserve the right to limit quantities, decline or cancel any purchase for reasons including pricing errors, suspected fraud or stock unavailability. Title and risk of loss pass to you when the package is handed to the carrier.
6. Pricing & Payment
All prices are shown in United States Dollars unless indicated otherwise. Applicable taxes and duties are calculated at checkout. We accept major credit cards, PayPal, Apple Pay and other methods displayed on the payment page. By submitting payment you represent that you are authorised to use the selected method.
7. Shipping & Delivery
Transit times are estimates and commence once your items leave our warehouse. Delays caused by customs, weather or carrier disruptions do not entitle you to cancel or claim compensation. Please see the dedicated Shipping Policy for full details.
8. Returns, Refunds & Exchanges
We want you to love every piece. Items may be returned within 30 days of delivery in original, unworn condition with tags attached. Final-sale merchandise, gift cards and personalised products are non-returnable. Shipping costs are refunded only when we have sent an incorrect or defective item. Processing takes up to 7 business days after we receive the parcel.
9. Intellectual Property
All content including photographs, graphics, logos, trademarks, page headers, button icons, scripts and product designs is owned or licensed by efrainwhitt and protected by international copyright, trademark and design laws. You may not reproduce, distribute, modify or create derivative works without prior written consent.
10. User Content & Submissions
Any material you upload, post or transmit through the site such as reviews, photos or comments becomes non-confidential. You grant us a perpetual, royalty-free licence to use, copy, adapt, publish and display such content worldwide for marketing or any lawful purpose. You warrant that you own or control all rights to the material and that it is accurate, lawful and non-infringing.
11. Prohibited Conduct
You agree not to: use data mining or similar extraction tools, upload viruses or harmful code, impersonate any person, collect personal data of others, engage in fraudulent activity or interfere with the proper working of the site. Violation may lead to immediate suspension and referral to law enforcement.
12. Third-Party Links
The site may contain links to external websites or integrations with social media platforms. We are not responsible for the content, policies or practices of any third-party service. Accessing such links is at your own risk.
13. Disclaimer of Warranties
We provide the site and all products on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not guarantee uninterrupted access, error-free operation or that the site is free of viruses or other harmful components.
14. Limitation of Liability
To the fullest extent permitted by law, efrainwhitt shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or inability to purchase or use products, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount paid by you for the product in dispute.
15. Indemnification
You agree to indemnify, defend and hold harmless efrainwhitt and its affiliates from any claims, liabilities, damages, losses or expenses including reasonable legal fees arising out of your breach of these Terms, your misuse of the site or your violation of any law or the rights of a third party.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, USA, without regard to conflict-of-law principles. If you are a consumer resident in the European Economic Area you may also benefit from mandatory provisions of the law of your country.
17. Dispute Resolution
Any dispute arising under or in connection with these Terms shall first be submitted to informal negotiation. If unresolved within 30 days it shall be finally settled by binding arbitration under the Rules of Arbitration of the International Chamber of Commerce by a single arbitrator in the English language. Judgment on the award may be entered in any court having jurisdiction.
18. Severability
If any provision of these Terms is held to be unlawful, void or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force.
19. Changes to Terms
We may revise these Terms at any time by updating this posting. Continued use of the site after changes take effect constitutes acceptance of the revised agreement.
20. Entire Agreement
These Terms together with any policies incorporated herein constitute the entire agreement between you and efrainwhitt and supersede all prior communications or agreements.
